What Is a VAWA Self-Petition and Who Is Eligible?

The Violence Against Women Act (VAWA) offers a path to safety and independence for victims of abuse. If you are a victim of abuse or domestic violence by a U.S. citizen or lawful permanent resident (LPR) spouse, parent, or child, you may be eligible to file a self-petition under VAWA. This allows survivors to apply for a green card without the abuser's knowledge or involvement, helping to ensure their safety.


You can file a VAWA self-petition if you are:

  • The spouse of an abusive U.S. citizen or LPR, including former spouses if the marriage ended due to abuse.

  • An unmarried child under 21 who was abused by a U.S. citizen or LPR parent.

  • A parent who has suffered abuse from your U.S. citizen child (age 21 or older).
