FAMILY-BASED IMMIGRATION
I-130 Petitions for Alien Relatives
The I-130 petition is the first step for a U.S. citizen or lawful permanent resident to sponsor a foreign relative for permanent residency. This petition establishes the qualifying family relationship, which is required for obtaining a green card. Depending on the beneficiary’s location, the process can be completed through consular processing if they are outside the U.S. or through adjustment of status if they are already in the U.S. and eligible to file concurrently.

Marriage-Based Green Cards & Adjustment of Status (I-485) Petitions
If you are married to a U.S. citizen or lawful permanent resident, I can assist you in obtaining a green card through marriage. For eligible applicants already in the United States, the I-485 adjustment of status petition allows them to apply for lawful permanent residency without needing to leave the country.
Concurrent Filing:
U.S. citizens may file the I-130 Petition for Alien Relative concurrently with the I-485 Application to Adjust Status for their:
Spouse
Unmarried children (under 21)
Unmarried sons and daughters (21 and older)
This concurrent filing process allows immediate relatives of U.S. citizens to complete the green card process from within the United States, avoiding consular processing abroad.
ADJUSTMENT OF STATUS FOR SPOUSES & CHILDREN OF LAWFUL PERMANENT RESIDENTS (LPRS):
Lawful permanent residents (green card holders) can petition for their spouse and unmarried children under 21using Form I-130.
However, unlike immediate relatives of U.S. citizens, these beneficiaries must wait for a visa to become available under the F2A preference category before filing Form I-485.
Crucially, the spouse or child must be in valid nonimmigrant status at the time of filing the I-485 and must not have violated the terms of their visa to be eligible for adjustment of status within the U.S..
If the beneficiary does not meet these criteria, they may need to pursue consular processing from their home country instead.
