ASYLUM: I-589 PETITIONS
Individuals who fear returning to their home country due to persecution may be eligible to apply for asylum in the United States. Form I-589, Application for Asylum and for Withholding of Removal, allows applicants to seek protection from deportation and remain in the U.S. while their case is pending.

ELIGIBILITY FOR ASYLUM:
To qualify for asylum, an applicant must demonstrate a well-founded fear of persecution based on at least one of the following protected grounds:
Who Can File a VAWA Self-Petition?
RACE – Persecution due to ethnic background, skin color, or ancestry.
RELIGION – Persecution for religious beliefs, forced conversion, bans on worship, or religious violence.
NATIONALITY – Persecution due to ethnic background, skin color, or ancestry.
POLITICAL OPINION – Persecution due to actual or imputed (perceived) political beliefs, activism, or opposition to the government.
MEMBERSHIP IN A PARTICULAR SOCIAL GROUP (PSG) – Persecution based on shared characteristics such as gender, sexual orientation, family ties, domestic violence survivors, or other social identities.

KEY FACTORS IN AN ASYLUM CLAIM:
CREDIBLE FEAR OF PERSECUTION – Must provide evidence of past persecution or a real and immediate threat of harm if returned to the home country. .
GOVERNMENT INVOLVEMENT OR INABILITY TO PROTECT – Persecution must come from the government or groups the government is unable or unwilling to control.
TIMELY FILING – The I-589 petition must be filed within one year of arriving in the U.S., unless an exception applies (e.g., changed conditions or extraordinary circumstances).
NO BAR TO ELIGIBILITY – Certain criminal offenses, prior denials, or resettlement in another safe country may disqualify an applicant.
